Dana James was sentenced to 9 years, while Brock James will serve 8.
Two Chillicothe men have been sentenced for their involvement in the April robbery of a local Burger King restaurant. In the Ross County Court of Common Pleas, Wednesday, Judge Scott Nusbaum sentenced Dana James to 6 years in prison for aggravated robbery and 3 years for the gun specification, which will run consecutively.
James was also sentenced to 30 months to run concurrently for a separate charge of aggravated possession of drugs.
His brother, Brock James, who had entered a guilty plea as part of a plea agreement, was sentenced to 8 years for his part in the aggravated robbery and 30 months for tampering with evidence. These will run concurrently.
Brock has prior felony convictions of vandalism and breaking and entering. Dana does not have prior felonies; although, his record does include misdemeanors.
Both will be subject to post release control for 5 years and 40 hours community service per month following their release.
They were also ordered to pay $2017.51 to Burger King and $85 to an employee who lost wages from missing work following the incident.
